OSHA does not certify kits. It sets requirements — and a kit either meets them or it doesn’t.

The short answer

OSHA does not publish a cleanup kit parts list. The Bloodborne Pathogens standard, 29 CFR 1910.1030, requires capabilities: appropriate PPE, an appropriate disinfectant, labeled leakproof waste containment, sharps containment, and hand hygiene.

A compliant kit is simply the box that puts all five within arm’s reach of the spill. Everything below is quoted from the standard itself, with the citation next to it.

Does OSHA actually require a cleanup kit?

No. Search the standard for the word “kit” and you will not find a requirement for one.

What the standard requires is that when a spill happens, your employees can respond correctly and immediately. Three provisions create that pressure.

First, decontamination is not optional and not deferrable:

“Contaminated work surfaces shall be decontaminated with an appropriate disinfectant … immediately or as soon as feasible when surfaces are overtly contaminated or after any spill of blood or other potentially infectious materials.” — 1910.1030(d)(4)(ii)(A)

Second, PPE has to already be there:

“The employer shall ensure that appropriate personal protective equipment in the appropriate sizes is readily accessible at the worksite or is issued to employees.” — 1910.1030(d)(3)(iii)

Third, the employer pays. PPE must be provided “at no cost to the employee” under 1910.1030(d)(3)(i).

Put those together and the practical conclusion is unavoidable. “Immediately or as soon as feasible” plus “readily accessible” means the supplies cannot live in a stockroom three floors away.

That is why kits exist. Not because OSHA names them, but because a single grab-and-go container is the only realistic way to satisfy those words at 9pm on a Saturday.

Who this applies to (it is not just healthcare)

The standard applies wherever there is occupational exposure, defined as:

“reasonably anticipated skin, eye, mucous membrane, or parenteral contact with blood or other potentially infectious materials that may result from the performance of an employee’s duties.” — 1910.1030(b)

The test is “reasonably anticipated,” not “frequent” and not “medical.”

If a job description includes cleaning up after an injury or an accident, exposure is reasonably anticipated. That pulls in restaurants, schools, gyms, hotels, retirement homes, tattoo and piercing studios, salons, transit operators, and janitorial contractors.

A useful sanity check: if you would send an employee to handle it rather than calling a remediation company, the standard is in play.

Here is the standard translated into contents, with the citation for each line.

The item OSHA never names but every real spill needs

Absorbent powder appears nowhere in 1910.1030. It is still the item that makes the rest of the rule achievable.

Your waste container must “contain all contents and prevent leakage of fluids during handling, storage, transport or shipping.” A bag of loose liquid does not meet that description.

Solidifying the spill first is how you get from a puddle on the floor to a sealed, compliant, transportable bag. It also removes the bulk of the contamination before disinfectant is applied, which is the order the standard implies and most people reverse.

What “appropriate PPE” legally means

“Appropriate” is not left to interpretation. The standard defines it by performance:

“Personal protective equipment will be considered ‘appropriate’ only if it does not permit blood or other potentially infectious materials to pass through to or reach the employee’s work clothes, street clothes, undergarments, skin, eyes, mouth, or other mucous membranes under normal conditions of use.” — 1910.1030(d)(3)(i)

Two consequences follow, and both are commonly missed.

  • Sizing is a compliance issue. The standard says “in the appropriate sizes.” One size of glove for a whole staff is a finding waiting to happen.
  • Latex allergy has its own clause. Hypoallergenic gloves, glove liners, or powderless alternatives must be readily accessible to employees who need them.

Eye protection deserves particular attention. Cleaning a floor-level spill puts your face above the work, and splash risk is highest during the removal step, not the disinfection step.

What counts as regulated waste — and what doesn’t

This is the most misunderstood definition in the entire standard, and it cuts both ways.

Regulated waste is defined as liquid or semi-liquid blood or OPIM, contaminated items that would release blood or OPIM in a liquid or semi-liquid state if compressed, items caked with dried blood or OPIM capable of releasing it during handling, contaminated sharps, and pathological or microbiological waste.

Now the part that surprises people. Vomit, urine, feces, and saliva are not automatically covered by 1910.1030. The definition of other potentially infectious materials lists specific fluids, and those are not among them — with two exceptions that matter enormously:

  1. Saliva in dental procedures.
  2. Any body fluid visibly contaminated with blood, and “all body fluids in situations where it is difficult or impossible to differentiate between body fluids.”

Read that second exception again, because it is where most workplaces actually land.

A pool of vomit on a dining room floor at closing time is not something a server can meaningfully differentiate. Neither is a mixed spill in a public restroom or on a school bus.

In practice, the safe and defensible position is to treat any bodily fluid spill your staff cannot positively identify as OPIM. It is also the position your insurer and your local health department will expect.

Norovirus makes this concrete. It is not a bloodborne pathogen and 1910.1030 does not govern it, yet it spreads through vomit at a dose small enough that airborne particles from an uncontained cleanup have caused documented outbreaks. Compliance and safety are not the same target, and the kit has to hit both.

Three requirements that aren’t in the kit at all

Buying kits is the easy half. These three provisions produce citations regardless of what is on your shelf.

1. A written Exposure Control Plan

Required under 1910.1030(c)(1), and it is not a one-time document:

“The Exposure Control Plan shall be reviewed and updated at least annually and whenever necessary to reflect new or modified tasks and procedures which affect occupational exposure.” — 1910.1030(c)(1)(iv)

A plan written in 2019 and never touched since is non-compliant even if it was perfect when written.

2. Training, at hire and every year

Training must be provided “at the time of initial assignment to tasks where occupational exposure may take place” and “at least annually thereafter,” under 1910.1030(g)(2)(ii). Annual training must fall within one year of the previous session — not within the same calendar year.

3. Hepatitis B vaccination offered within 10 working days

Under 1910.1030(f)(2)(i), the vaccine must be made available after training and within 10 working days of initial assignment, at no cost, to every employee with occupational exposure. Employees may decline, but the declination must be documented on OSHA’s specific form.

Ten working days is roughly two weeks. For seasonal or high-turnover operations, that clock is tighter than most managers realise.

Audit your kit in ten minutes

Take your current kit off the shelf and work down this list.

  1. Can one person carry it to a spill in under 60 seconds?
  2. Are there gloves in more than one size?
  3. Is there eye protection, not just a mask?
  4. Is there a gown or apron that covers street clothes?
  5. Is there absorbent capable of solidifying the largest spill you realistically expect?
  6. Is there a red or biohazard-labeled bag that closes and does not leak?
  7. Is there a disinfectant, and is it in date?
  8. Is there hand hygiene provision for a cleanup away from a sink?
  9. If your site has sharps, is there a puncture-resistant sharps container?
  10. Is there a scoop or scraper, so nobody picks anything up by hand?
  11. Has it been restocked since the last time it was opened?

Item eleven is the one that fails most often. A kit used once and put back is a kit that will fail when it matters.

Five failures inspectors find most often

  • Disinfectant used before removal. Spraying a puddle dilutes the disinfectant and spreads the contamination. Absorb, remove, then disinfect.
  • Ordinary trash bags. Black bin liners are neither leakproof under load nor labeled. They fail 1910.1030(d)(4)(iii)(B)(1) on two counts.
  • The kit is locked in an office. “Readily accessible” is a legal term, not a preference.
  • No restocking record. If you cannot show when it was last checked, you cannot show it was ready.
  • Training that never happened for part-time staff. The standard makes no distinction based on hours worked.
